Aggravated Battery With a Firearm
Aggravated battery with a firearm
Aggravated battery with a firearm or “agg batt” as lawyers call it, is sometimes charged instead of attempted murder in Florida. The allegations are usually that a defendant shot someone and they lived.
There is usually no issue of great bodily harm when a bullet enters a human body. There may be a valid defense of lack of intent (it was an accident), self defense under Florida's stand your ground law, or defense of others to an aggravated battery with a firearm charge.
